What is service of process?

Service of Process is a course of action by the court to give legal notice to an individual/entity involved in a legal proceeding. There are federal and state rules and procedures that each process server must follow in order to provide legitimate and legal service. The legal notice is given in the form of delivering legal documents to the individual/entity.

Does Writ Legal offer service of process outside of the United States of America?

Yes. Currently, Writ Legal is able to serve a process in virtually every single city across the continental United States, Alaska, and Hawaii. We also have contractors that can handle service in Canada, Puerto Rico, Dominican Republic, Virgin Islands and other select foreign countries. Please contact Writ Legal for more information.

Who can serve a process?

Each state has a specific set of guidelines determining who is legally eligible to carry out a service of process. It is important to note that a service of process must be served by an individual who is not a party to the action. If you are unsure of your state’s service of process rules, you may click on the link to find the most recent state rules for service of process within the United States at our convenient Process Serving Laws guide. It is important to note that if the person conducting the service of process is not legally eligible then your case could be potentially dismissed or disputed in a court of law. Writ Legal pre-screens each agent who serves process for our company to ensure that he/she has the proper credentials to serve a process in the United States, Canada, Puerto Rico, Dominican Republic, and the Caribbean.

Does a process server need to be licensed?

Some states require process servers to be licensed by the state, or in some cases be appointed by a court to serve in a specific county or on a case-by-case basis. Furthermore, some states require its process servers to be licensed and bonded in order to serve a process. Whatever the case may be, without an exception, all of Writ Legal’s contractors have the proper credentials to carry out any service of process across the United States of America and Canada. How do I become a Writ Legal contractor?

Writ Legal has a screening process for all prospective contractors to ensure that we are hiring quality process servers who are dedicated to this line of profession. We are currently accepting applications from individuals in every county across the country. Are there any restrictions on when and where a process can be served?

Depending on the state from which the documents originated from or the state of where the documents are going to be served dictates when or where a process can be legally served. For example, in some states such as Florida, New York or Virginia you cannot serve a process on someone at their residence on Sundays, nor can you serve them when they are traveling to and from a court of law. If you are a new client, please register now. If you are a returning client you may submit an order online. You may also fax your order to 888-290-0024.

If you are sending a hard-copy of your documents, please submit them to our corporate office where they will be dispatched accordingly.

What methods of payment does Writ Legal accept?

Can I email or fax my service documents to be served?

Yes, we accept email or fax copies of legal documents to be served but you must confirm with your clerk of court if serving copies are acceptable. If so, you may fax the documents to 301-263-7099 or you may also email your order to servicerequest@writlegal.com.

  • The ability to track the status of your service request online 24/7 at the convenience and comfort of your own home or office through a personalized log in information.
  • Electronic notification once service has been completed or suggestions if we run into any snags while handling your service.
  • Preparation of the required proof/affidavit of service for verification that service has been completed or a detailed return of non-service, affidavit of due-diligence or evasion.
  • A copy of your proof/affidavit of service or non-service emailed or faxed to your office or the ability to download a copy from our online database through our online web portal.
  • The handling of your original proof/affidavit of service in the exact manner that you specify.

How long does it take Writ Legal to serve a process?

  • Urgent Process: Service of process attempted same day or within 24 hours
  • Priority Process: Service of process attempted in 1-2 days
  • Express Process: Service of process attempted in 3-4 days
  • Standard Process: Service of process attempted in 5-7 days

How do I track the progress of my service(s)?

All clients are provided with a confidential user name and password for which they can track the status of all services through our convenient online web portal. You can also view past cases, download affidavits, and post one or multiple new services in a few easy steps. Clients may also check status by calling our office at 1.888.667.2038, Monday through Friday between the hours of 8:00 a.m. – 8:00 p.m. EST.

What happens after Writ Legal serves my documents?

After your documents are served, you will be notified via email. Furthermore, you will be provided with an “Affidavit of Service” which includes all of the pertinent information surrounding the service of process such as date, time, name of person/entity served, and the description of the person served. Each affidavit of service provided by Writ Legal is designed to meet your state or courts’ requirements. The Affidavit of Services is then notarized (if applicable) and either filed with the court or returned to your firm.

Does Writ Legal provide an affidavit of service once service has been completed?

Writ Legal automatically drafts a proof that your service upon the completion of each service of process. If required, the proof of service is notarized and a copy is made available through our online system for your viewing, and automatically emailed to you accordingly. At Writ Legal we also automatically each proof of service with the respective court or in the case of a federal matter, we mail it back to your office for e-filing. Please provide us with specific instructions regarding the handling of your proof of service.

Where do I retrieve my proof, affidavit, certificate, or return of service from?

Once a service has been completed a client will receive an electronic copy of the affidavit/proof/certificate/return of service with the option to download a copy from our online web portal. Furthermore, the original will be sent back in the manner of your choosing. This information must be conveyed to Writ Legal at the onset of service through the completion of our Client Authorization Form or in some other manner in writing.

Will Writ Legal file the proof, affidavit, certificate, or return of service with the court?

As part of Writ Legal’s service of process fee all affidavits of service are mailed back to the respective court unless the client would like to receive the original. All affidavits of non-service, due-diligence and evasion and proofs of service relating to federal cases will be returned to the client for filing. Please contact Writ Legal’s office for more information on how we handle the proofs of service and non-service.

What if the person/entity I need served cannot be found or is evading service?

If perfecting service is unsuccessful for any reason; for example, the service address for the defendant or deponent is vacant, or the subject has moved to another location before service can be perfected, or the person we are seeking to serve may be evading service, then Writ Legal can offer alternative solutions. Such solutions may include skip-tracing, non-video surveillance, or other methods to help move your case forward. What is skip-tracing?

Skip-Tracing is a term used for a basic or complex search and/or investigation of an individual or entity in order to locate a subject’s whereabouts or retrieve vital information on the subject. Skip-tracing may be an option for those who are looking to serve an individual/entity and do not have a current address for the defendant or deponent at hand. At Writ Legal we offer three levels of skip-tracing, simple skip-trace, smart skip-trace, and smart skip-trace plus depending on the information you are seeking.
